Overview

Sparkfive, Inc., doing business as Cliff ("Cliff," "we," "us," or "our"), respects your privacy and is committed to being clear about the information we collect, how we use it, and the choices you have. This Privacy Policy explains how we handle personal information when you visit our website at cliff.sparkfive.com (our "Site") and when you use our product intelligence platform and related services (together with the Site, the "Services").


Please read this policy alongside any agreement your organization has with us, which governs how we handle the content you provide through the platform itself.

1. An important distinction: Customer Data

Cliff provides a platform that manufacturers and their partners use to make product knowledge available to the people who sell and service their products. Our customers load their product documentation into the platform, and their authorized users work with it.


This Privacy Policy does not govern the documents, files, questions, results, and other content that our customers and their users submit to or generate within the platform ("Customer Data"). We process Customer Data on behalf of our customers, acting as their service provider and processor, under the terms of our customer agreements and data processing terms. Our customers decide what Customer Data is collected and how it is used, and their own privacy policies apply to it.


If you are a sales representative, distributor, technician, or other user working within a Cliff deployment provided by one of our customers, and you have questions about how your information is handled or want to exercise rights over it, please contact that customer directly. We will support them in responding to your request.


The rest of this Privacy Policy covers the information for which Sparkfive, Inc. acts as the controller.


  1. Information we collect

We collect information in three ways:

Information you provide. When you create an account, request a demo, contact us, subscribe to updates, or otherwise communicate with us, we collect information such as your name, business email address, phone number, company, role, and the contents of your messages.

Information we collect automatically. When you visit our Site or use the Services, we collect certain information automatically, including your IP address, browser and device information, pages viewed, links clicked, referring pages, and how you interact with the Services. We collect this through cookies and similar technologies, described in Section 5.

Information from other sources. We may receive business contact information about you from third-party data providers, event partners, and publicly available sources. We use it to understand potential interest in our Services and to support our sales and marketing.


3. How we use information

We use the information for which we are the controller to:


  • provide, operate, and maintain the Services and your account;

  • respond to your requests and provide support;

  • communicate with you about the Services, including administrative messages and, where permitted, marketing;

  • understand how the Services are used so we can improve them;

  • protect the security and integrity of the Services and prevent fraud or misuse; and

  • comply with our legal obligations and enforce our agreements.


4. AI and how we handle your data

Cliff relies on third-party artificial intelligence providers to power parts of the platform, including large language and embedding models. We want to be specific about what that means for your data.


We do not use Customer Data to train, fine-tune, or improve the foundation models that Cliff relies on, and we contract with our AI providers so that they do not use Customer Data submitted through the platform to train their models. Customer Data is processed to produce results for the customer who owns it. It is not used to build a general model that benefits other customers.


Separately, we generate operational and usage information about how the platform performs and how its features are used. We use this information to run, secure, and improve the Services. Where that information is connected to Customer Data, we handle it under our customer agreements.

5. Cookies and similar technologies

We and our providers use cookies, pixels, and similar technologies on our Site to keep it functioning, remember your preferences, understand traffic and usage, and support our marketing. You can control cookies through your browser settings, though some features may not work properly if you disable them.


Our Site does not currently respond to browser "Do Not Track" signals.

6. How we share information

We do not sell your personal information. We share the information for which we are the controller only as described here:


Service providers. We share information with vendors who perform services on our behalf, such as hosting, infrastructure, analytics, customer support, communications, and payment processing. They may use the information only to perform those services for us.


Affiliates. We may share information within our corporate family for the purposes described in this policy.


Legal and safety. We may disclose information where we believe in good faith that it is necessary to comply with the law or a legal request, to enforce our agreements, or to protect the rights, property, or safety of our users, the public, or us.


Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction. We will continue to protect it as described in this policy.

7. Data retention

We keep personal information for as long as needed to provide the Services, operate our business, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need it, we delete or de-identify it. We handle the retention and deletion of Customer Data under our customer agreements.

8. How we protect information

We host the Services on established cloud infrastructure in the United States and apply technical and organizational measures designed to protect personal information. These include encryption of data in transit and at rest, access controls that limit who can reach information based on their role, logical separation of each customer's data within the platform, and monitoring of our systems.


No system is completely secure, and we cannot guarantee absolute security. We work to protect information consistent with the sensitivity of what we hold and to strengthen our practices over time.

9. Where information is processed

Cliff is based in the United States, and we host and process information in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to and processed here, where data protection laws may differ from those where you live.

10. Your choices and rights

You can opt out of marketing emails at any time using the unsubscribe link in those emails. You will still receive administrative messages related to your account and the Services.


Depending on where you live, you may have rights over your personal information, such as the right to access, correct, delete, or receive a copy of it, and the right to appeal a decision we make about a request. To exercise a right over information we control, contact us using the details in Section 13. We may need to verify your identity before acting on your request, and we will respond as required by applicable law.


If your request concerns Customer Data handled through a customer's deployment, please contact that customer, as described in Section 1.

11. Children's privacy

The Services are intended for business use and are not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with information, please contact us and we will delete it.

12. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised policy.
